The article examines the peculiarities of protection IP, confidential information in framework open science European Union and Ukraine. It is noted that a number issues need to be resolved both at level legislation practice work state authorities, research institutions universities, including introduction access licenses; determination legal mechanisms for transfer electronic copies scientific articles, reports, data with ensuring copyright commercial secrets regarding patentable technical solutions, know-how; law amendments defining definition “data”, “open science”, etc. accordance Directive (EU) 2019/1024 other EU acts.
